Brazil’s telecommunications regulator, Anatel, has threatened sanctions against Elon Musk’s satellite internet company, Starlink. This threat comes amid a public confrontation between Musk and Brazilian authorities over the country’s decision to block his social media platform, X. The Supreme Court of Brazil ordered the nationwide suspension of X for failing to appoint a legal representative by a court-mandated deadline, in accordance with Brazilian laws. Anatel has instructed internet providers to block access to X following the court order. Artur Coimbra, a commissioner at Anatel, revealed that Starlink is the only company that has openly stated it would not comply with the court decision. This has raised concerns about potential penalties that could be imposed on Starlink, including fines and the revocation of its business license in Brazil.
The conflict between Elon Musk and Brazil dates back to April when an X representative stated that the company had been forced to block certain popular accounts due to court decisions. Musk responded by advising users to download a VPN to access X in case the social network was banned. The situation worsened as Brazil geared up for municipal elections in October. According to Brazilian laws, social networks must have an appointed individual who can receive and address government takedown notices related to political misinformation. X failed to comply with this requirement after removing all its staff from Brazil in response to ongoing tensions, sparking the recent legal disputes. The increased targeting of Starlink in this dispute further intensifies the ongoing conflict between Musk and Brazil, particularly exacerbating the billionaire’s feud with Brazilian Supreme Court Justice Alexandre de Moraes, who played a key role in the X ban.
Starlink disclosed on X that it had received an order from Justice Moraes freezing the company’s finances and prohibiting it from conducting financial transactions in Brazil. In response, X accused Moraes of intimidating its legal representative with imprisonment, claiming that the justice froze all of her bank accounts upon her resignation. Musk has vocally criticized Moraes, branding him an “evil tyrant” and advocating for his imprisonment. Additionally, Musk has denounced Brazil’s court rulings as censorship, further exacerbating the tensions between him and Brazilian authorities.
